Acceptable Use Policy

As a provider of Internet access (“Service”), SpaceCom offers its customers (also known as subscribers), and their customers and end users, the means to acquire and disseminate public, private, commercial, and non-commercial information. SpaceCom respects that the Internet provides a forum for free and open discussion and dissemination of information, however, SpaceCom reserves the right to take certain preventative or corrective actions if the Service is used in a manner contrary to those limitations set forth below. In order to protect these competing interests, SpaceCom has developed this Acceptable Use Policy (“AUP”), which supplements and explains certain terms of each customer’s respective service agreement and is intended as a guide to the customer’s rights and obligations when utilizing SpaceCom’s Services. This AUP will be revised from time to time. A customer’s use of SpaceCom’s Services after changes to the AUP are posted on SpaceCom’s web site, www.spacecom.com, will constitute the customer’s acceptance of any new or additional terms of the AUP that result from those changes.

One important aspect of the Internet is that no one party owns or controls it. This fact accounts for much of the Internet’s openness and value, but it also places a high premium on the judgment and responsibility of those who use the Internet, both in the information they acquire and in the information they disseminate to others. When customers obtain information through the Internet, they must keep in mind that SpaceCom is not providing such information and therefore, cannot monitor, verify, warrant, or vouch for the accuracy and quality of the information that customers may acquire. For this reason, the customer must exercise his or her best judgment in relying on information obtained from the Internet, and also should be aware that some material posted to the Internet is sexually explicit or otherwise offensive. Because SpaceCom cannot monitor or censor the Internet, and will not attempt to do so, SpaceCom cannot accept any responsibility for injury to its customers that results from inaccurate, unsuitable, offensive, or illegal Internet communications.

When customers disseminate information through the Internet, they also must keep in mind that SpaceCom does not review, edit, censor, or take responsibility for any information its customers may create. When customers and/or users place information on the Internet, they have the same liability as any author for copyright infringement, defamation, and other harmful speech. Also, because the information they create is carried over SpaceCom’s network and may reach a large number of people, including both customers and non-customers of SpaceCom, customers’ postings to the Internet may harm SpaceCom’s goodwill, business reputation, and operations. For these reasons, customers violate SpaceCom AUP and the service agreement when they, their customers, affiliates, or subsidiaries engage in prohibited activities.

Actions which constitute system abuse and are prohibited under this AUP include, but are not limited to:

  • Illegal Use. Using the Service in a manner that intentionally or unintentionally violates any applicable criminal or civil law, rule or regulation including, without limitation, copyright infringement.
  • Harm to Minors. Using the Service to harm, or attempt to harm, minors in any way.
  • Unauthorized Access. Using the Service in attempt to circumvent user authentication or penetrate security measures of SpaceCom’s or another entity’s network whether or not the intrusion results in the actual corruption or loss of data.
  • Threats. Using the Service to send content that threatens or encourages bodily harm or destruction to property.
  • Harassment. Attempting, in any way, to use the Service to interfere with or deny service to any user or any host on the Internet, including SpaceCom.
  • Forgery or Impersonation. Adding, removing or modifying email or email addresses, or posting header information in order to deceive or mislead, or attempting to impersonate any person.
  • Unsolicited email. Using the Service to send or attempt to send unsolicited email messages, or any activity that has the effect of facilitating unsolicited email.
  • Fraudulent Activity. Using the Service to make fraudulent offers to buy or sell merchandise, or service, or to advance any type of financial scam.
  • Intellectual Property Infringement. Using the Service to send any content that infringes intellectual property rights (such as copyright, trademarks, patent, etc.) of any third party.
  • Reselling the Service. Reselling the Service without SpaceCom’s authorization.
  • Collection of Personal Data. Using the Service to obtain personal information about another person without their prior consent.
  • Unfriendly Activity. Using the service for any activity that adversely impacts other users of the Service.
  • Only SpaceCom assigned IP addresses. The customer must only utilize IP address for which they are assigned by SpaceCom on the SpaceCom network. Injecting packets into the SpaceCom network with a source IP address other an address assigned to the customer is a violation. Customers may utilize other IP addresses within their network, but the customer must translate the network addresses (i.e. NAT packets a.k.a. Network Address Translation) on packets injected into SpaceCom’s network so that the source IP address is an address assigned to that customer by SpaceCom.

Specific rules governing servers:

Any servers (SMTP, FTP, proxy, etc.) running on SpaceCom’s network must be secure. Specifics of security include, but are not limited to:

  • SMTP servers must not be vulnerable to third party relay.
  • Proxy servers must not allow connections from outside your network.
  • In general, servers must not allow the abuse of SpaceCom’s or your resources by third parties.

Specific rules governing advanced Internet Service Provider services:

  • Customer’s must obtain Web Hosting services and any other advanced Internet Service Provider services (i.e. Firewall Protection or email accounts) from a third-party ISP.

Customer hereby acknowledges that SpaceCom reserves the right to block network traffic to/from any Gateways in violation of these rules or may temporarily limit Customer’s excessive usage to maintain overall network throughput. Violation of any of the rules in SpaceCom’s AUP may result in immediate termination of Service.

Violation of any of the rules in this AUP may result in immediate termination of Service.

SpaceCom reserves the right to modify and/or add to this AUP at any time, with or without notice. If you wish to report a SpaceCom user violating these rules, please send proof of the abuse to webmaster@spacecom.com.
